These Terms and Conditions (“Terms”) govern your access to and use of the PGB Sciences, LLC (“PGB,” “we,” “us,” “our”) website, including the purchase of any products offered through our website. These Terms, together with our Shipping Policy, Returns, Refunds & Reship Policy, Privacy Policy, Research Use Disclaimer, and Acceptable Use Policy (collectively, the “Policies”), form a binding agreement between you and PGB. By accessing our website, creating an account, placing an order, or using any PGB service, you agree to these Terms and all incorporated Policies in full.
1. Membership and eligibility
PGB is a members-only research peptide distributor. By registering, creating an account, accessing the catalog, or placing an order, you represent and warrant that you are at least 21 years of age, legally capable of entering into a binding agreement in your jurisdiction, and a qualified purchaser acquiring products solely for lawful in vitro laboratory research. Access to the catalog and ordering is limited to members whose accounts are in good standing. PGB may require age, identity, business, laboratory, institutional, or research-affiliation verification at any time, and may deny, suspend, or terminate access if PGB determines, in its sole discretion, that you are underage, unqualified, located in a restricted jurisdiction, or may use products for any prohibited purpose.
2. Orders and payment
All orders are subject to acceptance, eligibility review, compliance screening, payment verification, and stock availability. Website listings, catalog access, and posted prices are invitations to order and do not constitute binding offers by PGB. Your order constitutes an offer to purchase, and no contract is formed unless and until PGB accepts the order through written confirmation, shipment, or another affirmative acceptance notice. Prices are listed in U.S. dollars and may change without notice.
PGB currently accepts payment in cryptocurrency only. Accepted assets are SOL, BTC, USDC-SOL, PYUSD-SOL, and USDT-SOL. You are responsible for sending the exact asset and amount to the correct wallet, network, or payment address shown at checkout; blockchain transactions may be irreversible, and PGB is not responsible for losses caused by wrong-network transfers, underpayments, duplicate payments, wallet errors, network congestion, gas fees, miner or validator fees, exchange fees, or third-party payment-service failures. Additional payment methods, including credit card and bank transfer, may be added in the future and will be disclosed at checkout when available.
Cryptocurrency amounts are calculated at checkout based on then-current exchange rates. Orders are confirmed only after payment is received, verified, and cleared on the applicable blockchain or payment network. PGB reserves the right to refuse or cancel any order, in whole or in part, for any reason at our sole discretion, including payment verification failures, suspected fraud, misuse concerns, restricted shipping destination, suspected attempted circumvention of these Terms or any Policy, or violation of these Terms. Cancelled orders will be refunded, if at all, in accordance with our Returns, Refunds & Reship Policy, and PGB may offset network fees, processor fees, and documented losses where permitted by law.
3. Shipping
Title and risk of loss pass to the buyer upon PGB’s delivery of the package to the carrier. Delivery times are estimates and are not guaranteed. You are responsible for providing accurate shipping information.
PGB currently ships to U.S. addresses only and does not ship to PO boxes, mail drops, freight forwarders, reshippers, export agents, or any address that PGB determines presents elevated compliance, fraud, diversion, or delivery risk. We do not process or fulfill international orders at this time. Orders placed using freight forwarders, relabeled addresses, false recipient information, package-forwarding services, or other methods to circumvent our U.S.-only shipping policy will be cancelled or refused.
Certain products may be restricted or unavailable in specific U.S. states due to state-level regulations, carrier restrictions, compliance risk, or PGB’s internal risk controls. A current list of state restrictions is maintained in our Shipping Policy and may change without advance notice. Orders containing products restricted from the customer’s shipping state will be blocked at checkout, refused, cancelled, or, if discovered after payment, handled under the Returns, Refunds & Reship Policy.
PGB’s full Shipping Policy, including carrier selection, processing times, tracking, discreet packaging, and state-level restrictions, is incorporated into these Terms by reference.
4. Returns, refunds, and store credit
All sales are final. PGB does not accept returns, exchanges, cancellations after payment, or refunds for change of mind, ordering errors, market-price movement, wallet or network mistakes, delivery delays outside PGB’s control, or a purchaser’s failure to remain eligible to receive the order.
PGB’s default remedy for all approved claims (damaged, defective, missing, or incorrect items, or third-party testing failures) is store credit, issued to your PGB account and applicable to any future lawful purchase for which you remain eligible. Store credit does not expire and is non-transferable, has no cash value unless PGB elects or applicable law requires otherwise, and may be withheld, revoked, or limited if PGB determines that the claim involves fraud, misuse, prohibited conduct, restricted shipping, or policy circumvention.
Where a cash refund is required or offered at our discretion, refunds are issued in USDC or an equivalent USD-pegged stablecoin at the original USD transaction value, regardless of the cryptocurrency used for the original payment. PGB does not issue refunds in non-stablecoin cryptocurrencies (e.g., BTC, SOL) due to exchange rate fluctuation between time of payment and time of refund. Store credit may be converted to a stablecoin refund at PGB’s discretion upon request.
The full Returns, Refunds & Reship Policy, including claim windows, documentation requirements, reshipment limitations, store-credit mechanics, stablecoin refund mechanics, and our third-party testing guarantee, is incorporated into these Terms by reference. Failure to submit timely written notice, photographs, lot or batch information, packaging evidence, and any reasonably requested analytical data may result in denial of the claim.
5. Research Use Only
PGB is a chemical supplier. PGB is not a compounding pharmacy or chemical compounding facility as defined under §503A of the Federal Food, Drug, and Cosmetic Act. PGB is not an outsourcing facility as defined under §503B of the Federal Food, Drug, and Cosmetic Act.

All products sold by PGB are research chemicals intended exclusively for in vitro laboratory research conducted by qualified professionals in a controlled research setting. These products are not intended for, and must not be used for, human consumption, animal consumption, veterinary use, clinical use, diagnostic use, therapeutic use, cosmetic use, wellness use, performance-enhancement use, educational demonstrations involving human or animal subjects, or any form of in vivo administration to humans or animals, including but not limited to ingestion, inhalation, injection, infusion, implantation, or topical application.
PGB products are not drugs, foods, cosmetics, medical devices, or dietary supplements as defined by the U.S. Food, Drug, and Cosmetic Act or any comparable regulation in any other jurisdiction. These products have not been evaluated, reviewed, or approved by the U.S. Food and Drug Administration or any other regulatory authority. No statement made by PGB, on this website, in marketing materials, or in any other medium, should be construed as a medical claim or medical advice, health claim, or representation regarding the safety, efficacy, or suitability of any product for any use other than laboratory research.
No content published by PGB — including product descriptions, technical specifications, certificates of analysis, testing program documentation, marketing materials, or any other communication — is intended to suggest, recommend, or imply use of any PGB product to diagnose, treat, cure, mitigate, or prevent any disease, or to affect the structure or any function of the body. Any such suggestion, recommendation, or implication that may be inferred from PGB content is expressly disclaimed and is not authorized.
Product labeling and accompanying documentation are limited to identification (compound name, batch number, certificate of analysis reference) and laboratory handling and storage information. PGB does not provide, and product labeling does not include, directions for medical, therapeutic, cosmetic, or in vivo use of any kind. The buyer is solely responsible for determining safe and appropriate laboratory handling under applicable laws and institutional protocols.
By accessing this website, creating an account, communicating with PGB, or purchasing any product from PGB, you represent, warrant, and agree that:
- You are at least 21 years of age and legally capable of entering into a binding agreement in your jurisdiction.
- You are a qualified researcher, licensed laboratory professional, or authorized representative of a bona fide research institution.
- You will use all PGB products solely for lawful in vitro research purposes, in compliance with all applicable federal, state, local, and institutional laws and policies. You will not administer or permit the administration of any PGB product to any human or animal, and your purchase is not for in vivo use, resale for any non-research purpose, or any therapeutic, cosmetic, or wellness application.
- You will handle, store, transport, use, and dispose of all products in accordance with accepted laboratory safety standards and applicable law, having independently researched the chemical, physical, toxicological, and safety properties of each product before any use. You accept full and sole responsibility for your possession, handling, and use of any product purchased from PGB.
- Any material you produce, derive, or manufacture using any PGB product, and any further use of such material, shall not be adulterated or misbranded within the meaning of the Federal Food, Drug, and Cosmetic Act, and shall not be a material that, under Sections 404, 505, or 512 of the Act, may not lawfully be introduced into interstate commerce.
PGB expressly disclaims any and all liability arising from the misuse, improper handling, unauthorized use, or unlawful use of its products. Any use of PGB products outside of controlled laboratory research is strictly prohibited and is the sole responsibility of the purchaser.
If you do not agree to these terms, do not purchase or use any product from PGB.
6. Testing data and no warranty
PGB publishes testing data, certificates of analysis, and related documentation for informational purposes. While PGB invests significant resources in testing and quality verification, the buyer assumes responsibility for independently verifying product suitability for their specific research purposes.
PGB makes no warranties, express or implied, regarding the merchantability, fitness for a particular purpose, safety, efficacy, or suitability of any product for any use other than laboratory research. The buyer acknowledges that PGB products have not been sterilized, evaluated, or approved by the FDA for safety or efficacy, and that the buyer assumes all risk associated with possession, handling, and use of the products.
PGB products are intended solely for in vitro laboratory research and may not be listed on the Toxic Substances Control Act (TSCA) inventory. The buyer is solely responsible for verifying TSCA applicability and ensuring compliance with TSCA and any analogous chemical-substance inventories under applicable laws.
7. Indemnification
You agree to indemnify, defend, and hold harmless PGB, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use, misuse, handling, storage, or disposal of any PGB product, whether used alone or in combination with any other substance; (b) your violation of these Terms or any incorporated Policy; (c) your violation of any applicable law or regulation; or (d) your violation of the rights of any third party.
8. Limitation of liability
To the fullest extent permitted by law, PGB shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use or misuse of any product, access to or use of the PGB website, or any other matter related to these Terms. PGB’s total aggregate liability arising out of or related to these Terms or your purchase from PGB shall not exceed the amount you paid to PGB in the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of incidental, consequential, or certain other damages, so the foregoing exclusions and limitations may not apply to you. In such jurisdictions, PGB’s liability shall be limited to the maximum extent permitted by applicable law.
9. Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access or suspected breach. PGB may suspend or terminate accounts for suspected fraud, abuse, violation of these Terms, or any activity that threatens the security of PGB or other members.
10. Acceptable use
Use of PGB and our products is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy is grounds for immediate account suspension or termination, cancellation of pending orders, and, where applicable, referral to law enforcement.
11. Intellectual property
All site content, including text, graphics, logos, product names, testing reports, and certificates of analysis, is owned by PGB or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, publish, or create derivative works from any PGB content without our prior written consent.
The listing or sale of any material on the PGB website does not constitute a license to, or a recommendation for, the use of that material in infringement of any patent. The buyer is solely responsible for any patent clearance applicable to their intended use.
12. Force majeure
PGB shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, government or regulatory action, carrier disruptions, or failures of payment processors or blockchain networks.
13. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, the Policies, or your purchase from PGB shall be resolved exclusively through binding arbitration administered under the rules of the American Arbitration Association, seated in Delaware. The arbitrator’s award shall be final and binding. To the fullest extent permitted by law, you waive any right to participate in a class action or class arbitration.
Notwithstanding the foregoing, either party may bring an individual action in a court of competent jurisdiction seeking only injunctive or other equitable relief to protect its intellectual-property rights (including trademark, copyright, patent, or trade-secret rights). Such an action is not subject to the arbitration requirement of this Section.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court for any matter within that court’s jurisdiction, provided the claim remains in small claims court and is not transferred or appealed to any other forum.
15. Changes to these Terms
PGB may update these Terms and any incorporated Policy from time to time. The “Last updated” date and version number reflect the most recent revision. When material changes are made, existing account holders will be notified and prompted to re-accept the updated Terms on their next login. Continued use of PGB after notification and re-acceptance constitutes acceptance of the updated Terms.
